Is Government Mandated Health Care Unconstitutional?

This piece ran in the Wall Street Journal and it takes the dubious wisdom of ObamaCare and runs it through a constitutionality test. Government mandated health care probably does not cut constitutional muster. Of course, that may well be a moot point even if the issue ever reaches the U.S. Supreme Court. With four justices who actually believe the Constitution is still in effect and four who believe the Constitution is a quaint old document to work into an explanation of why the government should expand its authority. Then, there's Anthony Kennedy, the Harvey Dent AKA Two-Face of the Supreme Court, who seems to flip a coin to decide whether or not he is a jurist or a quasi-legislator. Hopefully, ObamaCare can be crushed before we get to the point of Justice Kennedy deciding how we all shall live.
